Intellectual Property Strategy Offer

Overview

Enterprise Ireland provides a range of Research, Development and Innovation (RD&I) supports to clients to help them develop novel solutions to address global market opportunities. To complement these Enterprise Ireland has developed a new ‘Intellectual Property (IP) Strategy Offer’, targeting SME clients that are existing recipients of EI RD&I support.

The aim of the new offer is to support these companies to develop an IP strategy focused on securing the maximum value from their RD&I activities. It will provide financial assistance to access the external IP expertise and to develop the in-house IP capability necessary to develop and embed the IP Strategy. The focus on IP Strategy encourages companies to recognise the full range of their RD&I related IP assets (including patents, designs, trade secrets, copyright, brands etc) and to deploy them strategically for the benefit of the business.

There are two grant schemes available under the IP Strategy Offer, IP Start and IP Plus

IP Start Grant

A grant to cover a portion of the cost of employing an IP advisor for a short engagement (up to 4 months) to raise awareness and address immediate IP issues linked to EI supported RD&I. The primary focus of the grant is to support companies to assess the technical feasibility of potential R&D. However, other scenarios are possible depending on client needs and nature of the linked RD&I activity.

IP Plus Grant

A grant to cover a portion of the cost of a medium-term (up to 18 months) consultancy and training assignment aimed at developing a detailed IP strategy linked to EI supported RD&I. Assignments will involve engaging external IP advisor(s) to address the IP strategic needs of the company and to transfer IP strategic capability to an internal IP Champion. Advisor and IP Champion will work collaboratively to implement activities and transfer IP knowledge to the company.

This grant focuses on full scale RD&I activity and aims to address a range of IP strategic issues including: awareness, competitive intelligence; processes and documentation; confidentiality, policy; data security; commercialisation, IP protection etc.

Am I eligible?

The IP Strategy Offer is only available to Enterprise Ireland Client companies that are SMEs, or, in limited circumstances, Innovative HPSUs. The support targets companies that are RD&I active but lack inhouse IP awareness and capability. Therefore, applicants must be able to provide details, via the application process, of a linked EI supported RD&I project (as detailed below) which is pertinent to the company’s current business plan.

IP Start

• Applicants must provide details of a ‘linked’ RD&I project which received support from EI (current or within the preceding 7 years) under at least one of the following programmes:

EI RD&I Fund 
EI Innovation Partnership Programme (Industry Partner) 
H2020 SME instrument Phase 1
• iHPSU, (minimum 6 months post investment)

IP Plus

• Applicants must provide details of a ‘linked’ RD&I project which received support from EI (current or within the preceding 7 years) under at least one of the following programmes:

EI RD&I Fund
EI Innovation Partnership Programme (Industry Partner)

What is the maximum IP Strategy Offer grant and what costs are eligible?

Applications are considered on a case-by-case basis and the level of funding will be determined following assessment of;
(a) the merits of providing grant support to the activity set out in the application
(b) the need for financial support
(c) previous funding provided to the company
(d) potential for employment and sales growth

Funding Limits

IP Start

Max Eligible Expenditure: €2,700

Grant Rate: Max 80% of eligible cost (max grant: €2,160)

Eligible Costs
• External IP advisory (consultant) cost for a maximum of 3 days at €900/day.

In-eligible Costs,
including but not limited to:
• Expenditure prior to date of application
• IP acquisition costs
• Licensing and royalty payments
• Patent filing in relation to technology acquisition.
• Professional fees to cover technical, commercial and legal due diligence
• Legal and professional costs in support of IP rights enforcement actions
• Sales related expenses
• Trade Fair participation costs
• Salaries
• Consultant expenses.
• Overheads

IP Plus

Max Eligible Expenditure: €70,000

Grant Rate: Max 50% for each category of eligible cost. (max grant: €35,000)

Eligible Costs
• External IP advisory cost up to a maximum of €35,000 at maximum of €900/day.
• Internal IP Champion cost based on a gross salary (capped at €80K) daily rate for time spent on assignment, up to a maximum of €35,000.

(Note: IP Champion cost cannot exceed external advisory cost or 50% of total project cost. This applies to both grant approval and final drawdown amounts, if different)

In-eligible Costs, including but not limited to:
• Expenditure prior to date of application
• IP acquisition costs
• Licensing and royalty payments
• Patent filing in relation to technology acquisition.

IP Advisor Directory

A directory of IP advisory service providers interested in undertaking assignments under the IP Strategy Offer is maintained by Enterprise Ireland. The directory holds profiles voluntarily provided by service providers on their IP related expertise and services provided. The aim of the directory is to provide IP Strategy Offer applicant companies with examples of the range of IP advisory services available to them. It is not an exclusive nor approved supplier directory and companies do not have to select a service provider from the directory.

It is the responsibility of individual companies to identify the service provider(s) to meet their specific needs, so please ensure that you carefully read the ‘Guidance on using the IP Advisor Directory’ (page 1 of the directory) prior to selecting from the list of service providers. Enterprise Ireland does not give any warranty, either express or implied, as to the qualifications or suitability of any of the persons on the directory of providers and Enterprise Ireland will not be liable for any loss and/or damage caused by a company’s decision to retain the services of such a service provider.

Service providers can apply to have their information added to the directory by completing this electronic form.  Inclusion in the directory will be based on relevant IP experience and expertise and the directory will be updated regularly. If an advisor would like to update or delete their information at any time they should email a request to IPStrategy@enterprise-ireland.com.

How do I apply?

If you are interested in applying please download and fill in the Expression of Interest Form. Email the completed form to IPStrategy@enterprise-ireland.com which will be reviewed, and a relevant EI person will contact you to discuss the proposed application.

All applications for funding should be discussed with your Enterprise Ireland Adviser prior to submission.
Apply via the Enterprise Ireland Online Application System.
Prior to applying you must do the following:
• Contact your assigned Enterprise Ireland Adviser to discuss your application.
• First time applicants who are existing Enterprise Ireland clients will be required to register on the Enterprise Ireland Online Application System.
Any expenditure incurred prior to receipt of the application by Enterprise Ireland will not be eligible for grant aid.
